Acting Newark Police Director Sam DeMaio doesn't want to set a particular precedent – releasing his internal affairs record.
That's despite requests from members of the city council and the head of New Jersey's American Civil Liberties Union chapter, who say the transparency is warranted since the Brick City's police department is under investigation by the U.S. Department of Justice for various civil-rights and other violations alleged by residents.
DeMaio told an interviewer on FOX 5 that he can't release the record because of Attorney General guidelines protecting it – but PolitiFact New Jersey has found an exception in the guidelines that would permit the release.
